RecoBuddy – Driver Terms and Conditions

These Driver Terms and Conditions (“Terms”) govern the use of the RecoBuddy platform by Drivers.
These Terms form a legally binding agreement between the Driver and RecoBuddy Ltd (“RecoBuddy”, “we”, “our”, “us”).
By registering as a Driver on the Platform, you agree to be bound by these Terms.
1. Platform Overview
RecoBuddy operates a digital technology platform that connects customers seeking vehicle recovery or vehicle transport services (“Users”) with independent service providers (“Drivers”).
RecoBuddy does not provide vehicle transport or recovery services.
Drivers operate as independent contractors and provide services directly to Users.
RecoBuddy acts solely as a technology marketplace facilitating bookings and payments.
2. Independent Contractor Status
Drivers using the Platform acknowledge and agree that:

Drivers are independent contractors

Nothing in these Terms creates an employment relationship

Drivers are not employees, agents, partners, or representatives of RecoBuddy
Drivers are solely responsible for:

their own taxes
-
insurance
-
equipment
-
operating costs
-
compliance with all laws
RecoBuddy does not provide employment benefits.
3. Driver Eligibility
To register as a Driver you must:
-
be at least 18 years old
-
have legal authority to operate in the UK
-
possess all required licences
-
maintain appropriate insurance
-
operate suitable vehicles and recovery equipment
RecoBuddy may request documentation including:
-
driving licence
-
operator licence (where required)
-
insurance certificates
-
vehicle documentation
Failure to provide documentation may result in suspension.
4. Driver Accounts
Drivers must:
-
provide accurate registration information
-
maintain up-to-date documentation
-
keep login credentials secure
Drivers are responsible for all activity conducted through their account.
RecoBuddy may suspend accounts suspected of fraudulent activity.
5. Acceptance of Jobs
Drivers may receive booking requests through the Platform.
Drivers may accept or decline job requests.
Once a Driver accepts a job request:
-
the Driver enters into a direct service agreement with the User
-
the Driver agrees to complete the service as described
Drivers must make reasonable efforts to fulfil accepted bookings.
Repeated cancellations may lead to reduced platform access.
6. Service Delivery
Drivers are solely responsible for the services they provide.
Drivers must:
-
transport vehicles safely
-
comply with UK road laws
-
use appropriate recovery equipment
-
act professionally toward Users
Drivers are responsible for any damage caused during service delivery.
7. Pricing and Platform Fees
Pricing for services may be determined by the Platform’s pricing system.
Drivers acknowledge that:
-
RecoBuddy charges a 20% platform service commission
-
commission is deducted from each completed booking
Drivers agree to the commission structure displayed in the Platform.
RecoBuddy reserves the right to adjust platform fees with reasonable notice.
8. Payments and Payouts
Payments are processed through Stripe Connect or similar payment processors.
Drivers agree that:
-
Users will pay through the Platform
-
Drivers will receive payouts through connected payment accounts
-
platform fees will be deducted automatically
Drivers are responsible for providing valid payout details.
RecoBuddy is not responsible for delays caused by payment processors.
9. Chargebacks and Payment Disputes
If a User disputes a payment or initiates a chargeback:
-
the payment processor may reverse the transaction
-
the disputed amount may be deducted from Driver earnings
Drivers agree to cooperate with investigations relating to payment disputes.
RecoBuddy may temporarily withhold payouts during investigations.
10. Insurance Requirements
Drivers must maintain valid insurance including where applicable:
-
motor insurance
-
public liability insurance
-
goods in transit insurance
Drivers are responsible for ensuring that their insurance covers vehicle transport and recovery activities.
RecoBuddy is not responsible for providing insurance coverage.
11. Vehicle and Equipment Requirements
Drivers must ensure that all vehicles and equipment used for services:
-
are roadworthy
-
comply with safety standards
-
are suitable for vehicle recovery or transport
Drivers must not operate unsafe vehicles.
12. Non-Circumvention
Drivers agree not to bypass the Platform.
Drivers must not:
-
solicit Users for off-platform bookings
-
exchange personal contact details for future work outside the Platform
-
attempt to avoid platform fees
Any attempt to circumvent the Platform may result in:
-
account termination
-
legal action
-
recovery of lost platform fees
13. Driver Conduct
Drivers must behave professionally at all times.
Drivers must not:
-
harass Users
-
engage in discriminatory behaviour
-
threaten Users
-
use abusive language
Serious misconduct may result in immediate removal from the Platform.
14. Ratings and Performance Monitoring
Users may rate Drivers after services are completed.
RecoBuddy may monitor driver performance including:
-
cancellation rates
-
completion rates
-
user ratings
Drivers with consistently poor performance may be suspended.
15. Fraud and Misuse
Drivers must not:
-
manipulate pricing
-
create fake bookings
-
submit fraudulent claims
-
misuse User information
Fraudulent behaviour may result in:
-
immediate account termination
-
legal action
-
financial recovery proceedings
16. Driver Data Responsibilities
Drivers may receive personal data relating to Users.
Drivers agree to:
-
use data only for completing bookings
-
not store or distribute User data
-
comply with UK GDPR requirements
Unauthorised data use may result in account termination.
17. Limitation of Liability
RecoBuddy shall not be liable for:
-
loss of earnings
-
service interruptions
-
user disputes
-
vehicle damage claims
-
third-party claims
Drivers assume full responsibility for services delivered through the Platform.
18. Indemnification
Drivers agree to indemnify and hold harmless RecoBuddy against any claims, damages, liabilities, or costs arising from:
-
service delivery failures
-
vehicle damage
-
legal violations
-
disputes with Users
19. Suspension and Termination
RecoBuddy reserves the right to suspend or terminate Driver access where:
-
Terms are breached
-
legal compliance issues arise
-
fraud is suspected
-
safety concerns are reported
RecoBuddy may terminate access without prior notice in serious cases.
20. Platform Changes
RecoBuddy may modify the Platform including:
-
pricing models
-
features
-
booking processes
Drivers will be notified of material changes.
Continued use of the Platform constitutes acceptance of updates.
21. Intellectual Property
Drivers may not use RecoBuddy branding, trademarks, or logos without permission.
Drivers must not represent themselves as employees of RecoBuddy.
22. Governing Law
These Terms shall be governed by the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
